TERMS OF USE

If you use the Site Services, please read the terms and conditions of these Terms of Use carefully.
The Terms of Use govern the relationship between the Buyer and the Store, namely: provision of familiarization services, sale of Goods.
The Terms of Use is a document that is a public offer agreement, and by accepting it, you agree to its terms and agree to abide by its provisions.
References to the words "we," "our," or "us" (or similar words in meaning) mean the Woodlandea Store.
References to the words "you" or "yours" (or similar words in meaning) mean our Buyer, the person to whom we provide the Site Services.
USE OF SERVICES IN ANY FORM MEANS ACCEPTANCE OF THESE RULES OF USE AND AGREEMENT TO FOLLOW THEM.
The headings used in this Terms of Use are included for convenience only and will not limit or otherwise affect these terms.
DEFINITIONS
1. Data is a common name for Personal and Statistical Data.
2. Buyer's consent (hereinafter "Consent") is a voluntary, specific, informed and unambiguous expression of will in which the Buyer, using a statement or an explicit positive action, agrees to the terms of Data processing.
3. Buyer is any individual or legal entity who purchases Goods in the Store.
4. Woodlandea Online Store (hereinafter referred to as “Woodlandea” or “Store”) is an online store on the World Wide Web, through which the Buyer can purchase the Goods.
5. Woodlandea Store website (hereinafter “Site”) means a web page or a group of web pages on the Internet located at the address: https://woodlandea.com/, through which the Store provides Services to the Buyer.
6. Personal Data is any information that is in closed access, which allows to directly or indirectly identify the Buyer. For example, first name, last name, phone number, IP address.
7. Statistical Data is any information that is publicly available and directly or indirectly belongs to the Buyer.
8. Services are the implementation by the Store of an algorithm of actions for the sale of the Goods chosen by the Buyer.
9. Third Party means a natural or legal person, government agency, commercial entity or body other than the Woodlandea Online Store, Processor, Controller and the Buyer.
10. Goods is a product posted on the Site and available for free sale.
USER CONSENT
1. The Buyer provides his/her Consent:
- confirms that he has reached the age of majority in his/her country or the Buyer has given consent for his minor dependents to receive the Services and buy the Goods;
- terms of payment for Services;
- terms of refund;
- terms of purchase of the Goods;
- conditions of these Terms of Use;
- not to use the Site and/or Services for illegal and unlawful purposes, including copyright infringement;
- not to transmit any worms or viruses or any code of a destructive nature in any way.
2. The User provides his Consent to receive promotional messages to his e-mail. The User has the right to refuse to receive such messages by writing to the Store's email address: woodlendea.uk@gmail.com
3. User Consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications Woodlandea provided to User electronically, via email, and on the Site, satisfy any legal requirement that such communication is in writing.
4. Woodlandea reserves the right to obtain the Buyer's Consent through the resulting form. The pop-up form can contain the Consent form in the form of a checkbox.
5. Any of the following actions signify Consent with the terms of this Terms of Use:
- signing these Terms of Use;
- purchase of Goods;
- receiving Services.
PROVIDING SERVICES. PAYMENTS
1. The Store provides the Buyer with access to the Goods posted on the Site, with the possibility of their purchase.
2. To purchase the Goods, the Buyer must create an order in the manner indicated on the Site. When creating an order, the Buyer pays the full price of the Goods in the form of a 100% advance payment.
3. The price of the Goods is indicated in the appropriate section of the Site. The Buyer pays for the order of the Goods in the manner specified in the relevant section of the Site, by using the payment services specified in the relevant section of the Site.
4. The Store manufactures the Goods for each Buyer. The terms of production of the Goods depend on the complexity of production and are from 2 to 8 weeks, but the terms of manufacture of the Goods may be changed in case of a large volume of the order.
5. Before sending the order for the Goods, the Store sends the Buyer a report on the readiness of the Goods, and after agreeing the production result with the Buyer, the Store delivers the Goods to the Buyer.
DELIVERY OF GOODS
1. The cost of delivery of the Goods depends on the country in which the Buyer is located, and the Store delivers to some countries for free, and the list of such countries is indicated in the corresponding section of the Site.
2. The Store delivers the Goods once or twice a month to the address specified by the Buyer. If the Buyer does not have the opportunity to receive the Goods in time, the Goods ordered by the Buyer will be stored in the Store's warehouse until the next delivery.
3. The Store can send the goods to the buyer using a special delivery service. In this case, the delivery of the Goods is carried out in accordance with the rules and conditions of such delivery service, and the delivery terms are specified by such service. In case of delivery of the Goods by a special service, such service is responsible for the preservation of the Goods during its delivery.
4. The goods are considered transferred from the Store to the Buyer from the moment of receipt by the Buyer.
5. The Store informs the Buyer in advance about the conditions and terms of delivery by e-mail.
REFUNDS
1. The buyer has the right to return/exchange the Goods of proper quality, within 14 (fourteen) calendar days from the moment of receipt, if the Goods did not satisfy him in terms of shape, dimensions, style, color, size or for other reasons cannot be used by him as intended. The Buyer returns/exchanges the Goods exclusively in accordance with the laws of England.
2. The Store exchanges Goods of proper quality only if such Goods have not been used and there are no signs of such use and/or there are no signs of damage to the Goods. If the Goods has been used or has signs of use or damage or is missing and missing the original packaging, then the Goods cannot be exchanged by the Store under any circumstances.
3. If the Buyer has discovered significant defects in the Goods, which were caused by the fault of the manufacturer of the Goods, the Buyer has the right to demand:
- return the money paid for the Goods;
- proportionally reduce the price of the goods or eliminate the defects of the goods free of charge within a reasonable time;
- demand replacement of the Goods with the same Goods or a similar Goods from among those available in the Stoer.
4. The Buyer sends the Goods of inadequate quality to the address specified by the Store. The relevant Store employee, within 5 (five) business days from the moment of receipt of such Goods, makes a decision: either to carry out an examination or to replace the Goods or to transfer funds, in accordance with the wishes of the Buyer.
5. The Store replaces the Goods of inadequate quality, if the damage to the Goods was not caused by the fault of the Buyer: If the Goods are available, - within a reasonable period of time, but no more than 14 (fourteen) calendar days. If there is a need for a quality check - within 14 (fourteen) calendar days from the end of the check or as agreed with the Store. If the Goods is not available - within two months from the moment of submission of the corresponding request by the Buyer.
6. If the Buyer submits a demand for free elimination of defects in the Goods of inadequate quality, the Store shall eliminate such defects within 14 (fourteen) calendar days from the date of establishing that the damage was not caused by the Buyer's fault or by agreement of the parties in another reasonable time.
7. The Store does not consider Buyers' requests under any circumstances to return/exchange Goods of inadequate quality, if the Buyer:
- violated the terms of use of the Goods;
- violated the terms of storage of the Goods;
- damage to the Goods was caused by the fault of the delivery service;
- violated the terms of repair of the Goods.
8. For a refund, the Buyer must send a request to the Store by e-mail: woodlendea.uk@gmail.com. The request for the return/exchange of the Goods must contain the following information: full name of the applicant; data about the Goods: name, date of purchase; reasons for return; defects of the Goods or damage to the Goods; address for exchange of Goods; payment details for refund.
9. The Store refunds funds within 14 (fourteen) calendar days from the moment the Store makes a decision to refund funds based on the payment details specified in the Buyer's request or exchanges the Goods at the address specified by the Buyer in the corresponding request or in accordance with the information specified in the relevant section of the Site.
10. In case of return of Goods of inadequate quality, the costs associated with the return of such Goods shall be borne by the Store. In case of return of Goods of proper quality, the costs associated with the return of such Goods shall be borne by the Buyer.
11. If the Buyer rejects the Goods before its manufacture, the Store can return to the Buyer the money paid for the Goods, excluding the cost of materials and/or the cost of the Services provided, related to the sale and delivery of the Goods.
INTELLECTUAL RIGHTS
1. All property and intellectual intellectual property rights to the program code and design of the Site, as well as their other components and elements, belong exclusively to the owner of the Store.
2. The Store grants the Buyer the non-exclusive right to use the Services and the content of the Site.
3. The Buyer grants the Store the non-exclusive right to use, copy, process and transfer Personal and Statistical Data during the term of using the Services.
4. All copyrights to the Goods belong exclusively to the owner of the Store.
5. The Goods is intended exclusively for personal use and is not intended for commercial use, and the Buyer does not have the right to:
- alienate the Goods;
- transfer the intellectual rights to use the Goods to any Third Party;
- use the manufacturer's intellectual rights on the Goods for its own purposes and/or for the purposes of a Third Party.
6. The buyer who believes that his intellectual and property rights have been violated can contact the Store with a request at the following email address: woodlendea.uk@gmail.com. Such a request must include: the full name of the Buyer, a description of the problem, contact details, evidence of infringement of intellectual and property rights. The Store considers such a request within 10 (ten) business days from the moment of receipt. By sending such a request, the Buyer confirms that:
- that the information specified in it is accurate and true,
- understands the full extent of responsibility for sending unreliable data,
- guarantees that such information does not violate copyright and/or other intellectual property rights of Third Parties;
- confirms that he has all the rights and authorities necessary and sufficient to send the request;
- gives the Store consent to the processing of his Personal Data.
RESPONSIBILITY
1. The Store is not responsible for any damages incurred by the Buyer as a result of the use of the Goods and/or damage to health/life, if the Buyer did not comply with the conditions of use/operation/storage/maintenance/repair of the Goods during use.
2. The Store is not responsible for the delivery of the Goods or for damage to the Goods during delivery, since the delivery of the Goods is carried out by a delivery service that is responsible for the delivery of the Goods or the preservation of its integrity during the delivery of the Goods. The Store is not responsible if the Buyer provided an incorrect address or did not receive the Goods for any reason.
3. The Store informs that the image of the Goods on the Site may differ from the appearance of the Goods received by the Buyer, and the Buyer undertakes not to make any claims regarding the discrepancy between the image on the Site and the appearance of the Goods upon receipt.
4. The Store is not responsible for:
- any expectations of the Buyer from the Goods purchased on the Site;
- the absence of a manager during non-working hours/weekends or failure to process the order of the Goods during non-working hours;
- damage to the Goods during its delivery by special delivery services;
- delay in the delivery of the Goods, which occurred through no fault of the Store.
5. The Store is not responsible if the Buyer wants to receive the Goods, the advertisement of which he saw on the Internet, and the Goods is currently unavailable in the Store.
6. After receiving the order for the Goods, the Buyer assumes full responsibility for the condition/storage of the Goods. That is why the Buyer is solely responsible for inspecting the Goods, and the Store is not responsible if the Buyer did not discover any defects when receiving the Goods.
7. The Store provides a 3-year warranty for the Goods, which extends exclusively to the overall integral structure of the Goods. This warranty does not apply to minor scratches or other cosmetic damage to the external coating of the Goods that may occur during operation. The Store only guarantees the Goods and that it remains fit for proper use.
8. The Store reserves the right, but not the obligation:
- track violations of the Terms of Use;
- take appropriate legal action against anyone who, in its sole discretion, violates English law or the Terms of Use, including, but not limited to, reporting such Buyer to law enforcement;
- in our sole discretion and without limitation, notice or liability, remove from the Site or otherwise disable all files and content that are excessive in size or otherwise burden our systems;
- to administer the Site in such a way as to protect our rights and property and to facilitate the proper functioning of the Site.
9. The Store, affiliates and agents are not responsible for any delay or failure of the Services caused by events beyond the control of the Store: natural disasters, Internet failures, equipment failures, power outages, strikes, labor disputes, riots, insurrections, civil disturbances , shortages, fires, floods, storms, explosions, natural disasters, wars, hostilities, epidemics, pandemics, government actions, court orders, etc.
APPLICABLE LAW AND DISPUTE RESOLUTION
1. All relations between the Store and the User arising from the fulfillment of the terms of these Site Services for the use and use of the Site Services are governed by the laws of the United Kingdom of Great Britain and Northern Ireland.
2. Any dispute arising out of or in connection with this contract, including any question regarding validity, or termination, shall be referred to and finally resolved by the London Court Of International Arbitration (LCIA) in accordance with the laws of England and Wales according to the rules of this ICAC, which, as a result of referring to it, is considered as the part of this clause. The number of arbitrators shall be one (1). The seat, or legal place, of arbitration, shall be London. The language of the proceedings shall be English. The governing law of the contract shall be the substantive law of the United Kingdom of Great Britain and Northern Ireland.
3. The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
DURATION OF TERMS OF USE
1. The Terms of Use are in effect during the period of use of the Site Services by the User. In the event of termination of the use of the Site Services and termination of relations between the parties, the Terms of Use conditions shall cease to have an effect.
CHANGES TO THE TERMS OF USE
1. The Woodlandea notifies the User about making changes to the Terms of Use within 7 (seven) business days. The Store updates the date of change of the current version of the Terms of Use in the line "Last update."
2. The User is obliged to read the new terms of the Terms of Use, and the Woodlandea is not responsible if the User has not read the new terms of the Terms of Use.
3. Our electronic or otherwise retained copies of the Terms of Use are considered valid, complete, and enforceable versions of these Terms of Use in effect at the time of your visit to the Site. If the User uses the Site Services after updating the Terms of Use, we have the right to assume that the User has read the new version of the Terms of Use and agrees to the terms of the Site Services.
