Welcome to Woodlandea this is a Store through which the Buyer can get acquainted with the Goods and purchase them.

The Privacy Policy regulates the procedure for processing and ensuring the security of Personal and Statistical Data when receiving Services.

In this document, we describe the methods of collection, processing, storage, disclosure and transfer of Personal and Statistical Data when receiving the Services.

The provisions of this Privacy Policy apply only to Personal and Statistical Data collected by Woodlandea.

References to the words "you" or "your" (or similar words) mean the User, depending on the context of the Privacy Policy.

References to the words "we", "our" or "us" (or similar) refer to the Woodlandea Store.

DEFINITIONS

1. Data is a common name for Personal and Statistical Data.

2. Buyer's consent (hereinafter "Consent") is a voluntary, specific, informed and unambiguous expression of will in which the Buyer, using a statement or an explicit positive action, agrees to the terms of Data processing.

3. Buyer is any individual or legal entity who purchases Goods in the Store.

4. Woodlandea Online Store (hereinafter referred to as “Woodlandea” or “Store”) is an online store on the World Wide Web, through which the Buyer can purchase the Goods.

5. Woodlandea Store website (hereinafter “Site”) means a web page or a group of web pages on the Internet located at the address: https://woodlandea.com/, through which the Store provides Services to the Buyer.

6. Personal Data is any information that is in closed access, which allows to directly or indirectly identify the Buyer. For example, first name, last name, phone number, IP address.

7. Statistical Data is any information that is publicly available and directly or indirectly belongs to the Buyer.

8. Services are the implementation by the Store of an algorithm of actions for the sale of the Goods chosen by the Buyer.

9. Third Party means a natural or legal person, government agency, commercial entity or body other than the Woodlandea Online Store, Processor, Controller  and the Buyer.

10. Cookie is information in the form of text or binary data that is used by Woodlandea when providing Services and providing access to the Site.

11. Controller means any natural or legal person, government agency, institution, or other body that independently determines the purposes and means of personal data processing.

12. Processor is a natural or legal person, government agency, institution, or other body that processes Personal Data on behalf of and behalf of the Controller.

13. Goods is a product posted on the Site and available for free sale.


GENERAL PROVISION

1. The Store processes and stores Personal Data based on the principles of legality, fairness and transparency by Article 5 "Principles relating to processing of personal data" of the GDPR and on the conditions by Chapter 2 “Legal basis for processing personal data” of the Federal Data Protection Act (BDSG).

2. Woodlandea acts as a Processor of Data that it receives during the provision of Site Services to the Buyer, including those data that the Buyer transfers on his initiative.

3. The Store is not responsible for the processing of Data by Third Parties that are not controlled or owned by Woodlandea.


PERSONAL AND STATISTICAL DATA

1. The Store can receive the following Personal Data about the Buyer:

  • First name;
  • Last name;
  • Email;
  • Location (Country/City);
  • Phone number;
  • Payment data - only for receiving payments;
  • Communication languages.

2. The Store can receive the following Statistical Data about the Buyer (legal entity):

  • company data: name, legal address, form of business activity, country of registration and activity, IBAN, field of activity, data on employees and management, etc.;
  • registration/tax number;
  • contact information: phone number, e-mail, etc.;
  • payment/bank details, exclusively for receiving payment for Services;
  • publicly available employee data.

3. The Store can collect the following Personal Data about the Buyer's employees (legal entity):

  • First name;
  • Last name;
  • Email;
  • Location (Country/City);
  • Communication languages.

4. The Buyer can provide any of his Data during communication with the Store employees or any other interaction with the Store, in this case, the Woodlandea processes such data under the terms of this Privacy Policy.

5. Woodlandea does not collect or process sensitive Personal Data of Users, such as race or ethnic origin, political views, religious or philosophical beliefs, union membership, genetic or biometric data, health information, sexual life, or sexual orientation.

6. The Store has the right to process and publish public information about legal entities that are freely available, including receiving public information about a legal entity about the Buyer.

7. The Store has the right to obtain Personal and Statistical Data through the use of social networks, including, but not limited to: Instagram and Facebook.

8. The Store can process the Buyer's Data, which he leaves during communication with the Store's employees, by using the feedback form posted on the Site.

9. Woodlandea has the right to collect and receive the Data as follows:

  • during the provision of Services;
  • during the sale of the Goods;
  • when interacting with Woodlandea employees, through the exchange of emails/messages;
  • during monitoring and evaluation of the Buyer's actions to detect and prevent fraud;
  • when using log files, cookies and other tracking technologies;
  • using messengers and social networks.

10. The Store has the right to use Data for the following purposes:

  • providing Services;
  • selling of the Goods;
  • ensuring the security of the Site;
  • administration of the Site and conduct internal operations, including troubleshooting, data analysis, testing, and improving the navigation of the Site based on your preferences;
  • communication with the User;
  • for responding to requests from law enforcement agencies;
  • for responding to lawsuits, investigating or resolving disputes with the User.

11. The Store reserves the right to obtain Personal Data and/or Statistical Data for the provision of Site Services. If the Buyer refuses to provide  Personal Data and/or Statistical Data, the Woodlandea has the right to terminate any relationship with such User.

12. The Store may use Customer Data for marketing purposes, including for sending new offers regarding the Goods.


PERSONAL AND STATISTICAL DATA TRANSFER

1. The Store has the right to transfer Personal and Statistical Data to Third Parties for the implementation and provision of the Site Services and/or protection of its legal interests:

  • Contractors and employees. The Store may transfer Personal and Statistical Data to other entities with which it will cooperate, including legal and tax consultants and entities that provide accounting, marketing and IT services.
  • Courts, law enforcement, and government agencies. The Store has the right to transfer Personal and Statistical Data in the event of fulfilling any legal obligations, including in connection with a court ruling.
  • Third-Party. The Store has the right to disclose or transfer the Personal and Statistical Data during the following transactions: acquisition or merger, financing, corporate reorganization, joint venture, including the sale of assets or in the event of bankruptcy.

PERSONAL DATA STORAGE AND PROTECTION

1. The Store uses all necessary security and protection measures for Personal Data to ensure its confidentiality and prevent loss or misrepresentation.

2. The Store protects and stores Personal Data from:

  • losses;
  • illegal use, transfer, disclosure, alteration, removal, and/or destruction.

3. We may use the following methods to protect Personal Data in accordance with the article "Security of processing" 32 GDPR:

  • ability to ensure constant confidentiality, integrity, availability and fault tolerance of Personal Data processing systems;
  • testing, evaluation and measurement of the effectiveness of technical and organizational measures to ensure the security of processing Personal Data.

4. We may use the following methods to protect Personal Data in accordance with the Section 64 "Requirements for the security of data processing"(BDSG).

5. The Store may delete Personal and Statistical Data upon receipt of a request from the Buyer and upon the termination of the relationship. By deleting Personal and Statistical Data, we mean deleting all Personal and Statistical Data from servers and/or from all physical storage mediums (for example, hard drive, computer, laptop, etc.).

6. Woodlandea has the right to retain the Personal and Statistical Data for 5 (five) years after the termination of the relationship in the following cases:

  • for statistical accounting;
  • if the current legislation requires their storage;
  • to provide Services;
  • to send marketing offers;
  • for systematization of legal entities that provide services in the categories and subcategories indicated on the Site;
  • if they are necessary for doing business.

7. The Store does not store the User's Personal Data in the event of a request to delete Personal Data on his behalf in accordance with the right to delete.

8. Store has the right not to delete Personal and Statistical Data in the event of a reorganization of the Store` company, the Store merger with another company, or any other changes in the Store’ company structure, and the event of a change of server.


BASIS FOR PROCESSING PERSONAL AND STATISTICAL DATA

1. The Store processes Personal and Statistical Data based on the following legal grounds:

  • User's Consent;
  • Site Services provision to the User;
  • to comply with applicable law, for the proper level of our business, to enter into and execute corporate transactions (sale of shares/stocks, mergers, acquisitions), to fulfill its obligations to you and/or a Third Party.

2. In cases where the basis for the processing of Personal and Statistical Data is your Consent, you have the right to revoke it at any time. In the event of withdrawal of your Consent, the Store has the right to terminate the provision of the Site Services and terminate all relations with you. If the Consent is revoked, your Personal Data will be permanently deleted, and Statistical Data may be stored in the directory of the Site, and Statistical Data may be stored in the directory of the Site.

3. The Store undertakes to stop processing Personal and Statistical Data within 10 (ten) business days from the date of receipt of the withdrawal of the Consent.


JURISDICTION OF THE EUROPEAN UNION AND THE EUROPEAN ECONOMIC ZONE

1. The terms of this section apply to residents of the European Union and the European Economic Area. By the terms of this clause, the Buyer has the following rights:

  • Right of access. The Buyer may contact us directly to request access to the Personal and Statistical Data we hold about them, as well as to any information in accordance with Article 15 of the General Data Protection Regulations.
  • Right to erase. The Buyer has the right to delete Personal and Statistical Data about himself, in accordance with Article 17 of the General Data Protection Regulations. Personal Data, in this case, will be deleted forever.
  • Right to rectification. The Buyer has access to Personal and Statistical Data, which must be updated, corrected, and supplemented at any time, it according to Article 16 of the General Data Protection Regulations.
  • Right to data portability. We may send the  Personal and Statistical Data Users to third parties at the request of the User, in accordance with Article 20 of the General Data Protection Regulations.
  • Right to object. The Buyer has the right at any time to object to the processing of their Personal and Statistical Data in accordance with Article 21 of the General Data Protection Regulations.
  • Automated individual decision making, including profiling. The Buyer has the right not to fall under a decision based solely on automated processing of his Personal and Statistical Data, including profiling, which has legal consequences or thus significantly influences him.
  • Right to lodge a complaint with the Federal Commissioner. Without prejudice to any other administrative or judicial remedy, every Buyer shall have the right to lodge a complaint with the Federal Commissioner, if the data subject believes that the processing by public bodies of personal data relating to him or her for the purposes infringes his or her rights, in accordance with Section 60 “Right to lodge a complaint with the Federal Commissioner” of the (BDSG).
  • Right to lodge a complaint with the Federal Commissioner. Without prejudice to any other administrative or judicial remedy, every Buyer shall have the right to lodge a complaint with the Federal Commissioner, if the data subject believes that the processing by public bodies of personal data relating to him or her for the purposes  infringes his or her rights. 

2. The Buyer must provide sufficient information to confirm his identity, whose Personal and Statistical Data are processed by the Store. If the Buyer cannot confirm his/her identity, the Store has the right not to fulfill such a request until the confirmation of such identity.

3. The User's request must contain accurate information on the requirements it places on the Store. If the request does not specify the exact requirements, the Store has the right to refuse to fulfill the request.

4. We will not be able to respond to your request or provide you with Personal and Statistical Data unless we are able to verify your identity or authority and confirm that the Personal and Statistical Data relates to you. In case of receiving a request with inaccurate information and/or in case of impossibility to verify the identity of the User, the Store has the right not to process the received request and apply to the Buyer for clarifications. If a request for clarification is received, the Buyer is obliged to submit a new corrected request.

5. The Store must respond to the requestor and fulfill the conditions outlined in the request within 21 (twenty-one) business days from the date of receipt.


JURISDICTIONS OF OTHER COUNTRIES

1. The Store makes every effort to legally process Personal and Statistical Data under international standards.

2. This Privacy Policy sets out the main legislation regarding the processing of Personal and Statistical Data.

3. Unfortunately, we do not have the opportunity to specify the legislation on the Personal and Statistical Data processing of each jurisdiction in the world.

4. The conditions of this Privacy Policy describe the fundamental rights of the Buyer provided for in the basic provisions of the leading legal acts governing the processing of Personal and Statistical Data.

5. RESPONSIBILITY

1. The Store notifies the Buyer that Personal and Statistical Data may be used to provide the Services, and in case of disagreement, the Buyer must leave the Site and not use the Services.

2. The Store is not responsible for:

  • loss of Personal Data in the event of a hacker attack, hacking of the Site software, illegal actions of third parties, illegal actions of the User, and actions that violate the terms of the Privacy Policy;
  • for the processing of Personal and Statistical Data by a Third Party;
  • provision by the Buyer of inaccurate Personal and Statistical Data.

3. The Buyer is solely responsible for the accuracy of the Personal and Statistical Data posted on the Store Site.

4. Unfortunately, the transmission of information via the Internet may not be completely secure. Although we make every effort to protect your Personal and Statistical Data, we cannot guarantee the secure process of transferring your Personal and Statistical Data to our Site. In this regard, you are solely responsible for possible failures in sharing your Personal and Statistical Data with the Site. Upon receipt of your Personal and Statistical Data, we undertake the necessary technical and security measures to prevent unauthorized access to your Personal and Statistical Data.

5. Buyer agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Store, use of the Store, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

6. Buyer understands that his content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.


BUYER CONSENT

1. The following actions of the Buyer are considered to be the Consent of the Buyer to the terms of processing of Personal and Statistical Data:

  • providing Consent in the form of using the checkbox form;
  • purchase of the Goods.

2. By signing the Privacy Policy, the Buyer agrees to:

  • processing of Personal and Statistical Data by the Store;
  • transfer of Personal and Statistical Data to Third Parties, in accordance with the terms of this Privacy Policy;
  • processing of payment data to receive payment for the sold Goods;
  • use of Data for marketing purposes, including sending messages with offers of new Goods.

3. The Store reserves the right to obtain the User's Consent through a pop-up form. The pop-up form may contain the Consent form in the checkbox form.


COOKIES

1. Cookie is a small file that is placed on your computer, mobile device, or tablet and contains an identification code that allows us to recognize your computer, mobile device, or tablet and provide you with the best possible experience on our Site. 4. Google Analytics is a convenient and versatile service from Google for analyzing Internet sites and mobile applications. Allows webmasters to check the status of indexing, create detailed statistics of the site's audience and optimize the visibility of their web pages. 

5. The Store uses Cookies for the following purposes:

  • Buyer authentication;
  • storage personal preferences and settings of the User;
  • storage of the authorization token on the Site;
  • tracking the User's access session;
  • storage statistics information about the User;
  • tracking the location of the User;
  • tracking Buyer behavior.

6. Cookies do not transmit viruses and/or malicious software to your computer, as the data in the Cookie does not change when moved and does not affect the operation of your computer in any way. Instead, they act more like logs (that is, they record Buyer activity and remember state information) and are updated every time you visit the Site.

7. You may revoke your Consent to the use of Cookies at any time and/or change the categories of Cookies you allow. You may also disable Cookies by changing the settings of your web browser. The information that Cookies collect is in an anonymous form.

8. Some Cookies are necessary for the Site to function properly and some are not necessary, but they help us improve the Site. ADULT POLICY

1. The Services are intended for adult Buyers. The Store does not process Personal Data of minors.

2. Woodlandea has the right to delete the Personal Data of a minor, without warning and any consequences for the Store, and to terminate the Site Services provision of such person.

CHANGES TO THE PRIVACY POLICY

1. The Store has the right to change the Privacy Policy provisions to ensure the preservation of Personal Data and in case of changes in the legislation governing the processing of Personal Data.

2. The Store is obliged to familiarize himself with the new terms of the Privacy Policy, and the Woodlandea is not responsible if the Buyer has not read the new terms of the Privacy Policy.

3. Digital or otherwise saved copies of the Privacy Policy are considered authentic, complete, valid, and subject to compliance with the versions of the Privacy Policy at the time the Buyer visits the Site. If the Buyer uses the Site Services, then he agrees with the new rules for the processing of Personal Data.
